This Privacy Notice explains how Simworx Flight Simulators S.L.U. (“Simworx”, “we”, “us” or “our”) collects, uses, shares and protects personal data when you visit sim-worx.com, create an account, join our mailing list, contact us, request a quotation, place an order, purchase a product or service, arrange delivery or installation, or seek after-sales support.

It applies to individual customers, prospective customers, business contacts, suppliers, distributors and representatives of organisations that deal with us. It does not form part of any contract of employment or engagement.

3. Personal Data We Collect

Depending on your relationship with us, we may collect the following categories of personal data:

• Identity and contact data: name, business name, job title, billing and delivery addresses, email address and telephone number.

• Account data: login details, account preferences, order history and communications associated with your website account.

• Order and project data: products, specifications, customisation requests, quotations, contracts, project correspondence, installation arrangements, acceptance information, warranty details and support history.

• Transaction data: payments, deposits, refunds, balances, invoicing details and limited payment-related information. Online card payments are processed by Stripe. Full card details are handled by Stripe and are not stored by Simworx.

• Delivery and customs data: recipient details, shipping documentation, import/export information and information required by couriers, freight forwarders, customs agents and public authorities.

• Communications data: enquiries, emails, telephone notes, contact-form submissions, complaints, reviews and other correspondence.

• Marketing data: mailing-list subscriptions, marketing preferences, campaign engagement and records of consent or objection.

• Technical and usage data: IP address, device and browser information, login data, pages viewed, interactions, referring website and cookie or similar technology identifiers.

• Business-contact data: professional contact information obtained from you, your organisation, referrals, trade events, distributors or legitimate public business sources.

Please do not send us special-category personal data or other sensitive information unless it is genuinely required and we have specifically requested it.

We collect personal data:

6. Marketing Communications

We may send marketing communications where you have consented or, where permitted by law, where there is an existing customer relationship and the communication concerns similar Simworx products or services. You can unsubscribe at any time by using the link in a marketing email or contacting support@sim-worx.com.

Withdrawing consent or objecting to marketing does not prevent us from sending necessary service messages about an enquiry, quotation, order, payment, delivery, installation, warranty or support matter.

7. Cookies and Similar Technologies

The website uses cookies and similar technologies for essential website and shop functions, preferences, analytics and marketing. Non-essential technologies, including relevant Google and Meta analytics or advertising technologies, will be used only in accordance with the choices made through our cookie settings. • Stripe, which processes online card payments, and relevant financial institutions;

• couriers, freight forwarders, logistics providers, customs agents and installation contractors;

• Mailerlite and other communications or mailing-list providers;

• Google and Meta where their analytics or advertising technologies are enabled with the required consent;

• accountants, tax advisers, legal advisers, insurers, auditors and debt-recovery providers;

• distributors, suppliers and subcontractors involved in fulfilling a quotation, order, project or support request;

• tax, customs, regulatory, law-enforcement, judicial and other public authorities where disclosure is required or lawful; and

• a prospective purchaser, investor or successor in connection with a genuine sale, investment or reorganisation of all or part of the business, subject to appropriate confidentiality and data-protection safeguards.

We do not sell personal data.

9. International Transfers

Simworx sells and delivers products internationally. Personal data may therefore be shared with recipients outside the European Economic Area when necessary to fulfil an international order, arrange delivery or customs clearance, provide installation or support, or operate services supplied by international technology providers.

Where data-protection law requires safeguards for a transfer, we use an approved mechanism such as an adequacy decision, the European Commission’s standard contractual clauses or another lawful safeguard. You may contact us for further information about the safeguards relevant to your personal data.

10. Data Retention

We keep personal data only for as long as reasonably necessary for the purpose for which it was collected, including to fulfil contracts, provide warranties and support, maintain product and project histories, establish or defend legal claims, and meet accounting, tax, customs and regulatory obligations.

Retention periods vary according to the type of record. In particular, commercial and accounting documentation will generally be retained for at least the periods required by Spanish law, which may include six years for relevant business records. Marketing data is retained until consent is withdrawn, an objection is made or the information is no longer required, subject to keeping a minimal suppression record so that the preference can be respected.

We use appropriate technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. Access is restricted according to business need, and providers processing personal data for us are required to protect it appropriately. No internet or storage system is completely secure, but we review and improve our safeguards as appropriate.

Subject to the conditions and exceptions in applicable law, you may have the right to:

• request deletion of personal data;

• withdraw consent at any time where processing is based on consent, without affecting earlier lawful processing; and

• not be subject to a decision based solely on automated processing that produces legal or similarly significant effects, where this right applies.

13. Complaints

Please contact us first if you have a concern so that we have the opportunity to address it. You also have the right to lodge a complaint with the Agencia Española de Protección de Datos (AEPD), the Spanish data-protection authority, through www.aepd.es, or with another competent supervisory authority where applicable.

14. Children

Our website and products are not directed at children for the purpose of collecting their personal data. Orders must be placed by a person with legal capacity to enter into the relevant contract. If you believe that a child has provided personal data to us improperly, please contact support@sim-worx.com.

15. Third-Party Websites and Services

The website may contain links to third-party websites, platforms or services. Those third parties control their own privacy practices, and their notices should be reviewed separately. Simworx is not responsible for the privacy practices of an independent third party.
